1. Acceptance of Terms

By accessing or using the Aquavoss website (the "Site"), purchasing products, or interacting with our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Site.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use this Site and purchase our products.

3. Products and Services

Aquavoss designs and sells premium hot tubs, cold plunges, accessories, and related wellness products ("Products"). Product descriptions, specifications, pricing, and availability are subject to change without notice.

We make commercially reasonable efforts to accurately display product features and colors, but variations may occur due to materials, lighting, or display settings.

4. Orders and Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or availability.

Prices are listed in U.S. dollars unless otherwise stated. Payment must be received prior to shipment. Taxes, shipping, installation, electrical work, permits, and site preparation are the responsibility of the customer unless expressly stated otherwise.

5. Shipping, Delivery, and Installation

Delivery timelines are estimates only, are not guaranteed, and may be impacted by force majeure events.

Title and risk of loss transfer to you upon delivery.

Unless explicitly included in writing, Aquavoss does not provide installation, electrical, plumbing, crane services, or site preparation. All installations are performed by third-party contractors selected by the customer.

You are solely responsible for ensuring proper access, electrical service, drainage, and compliance with all applicable local, state, and federal codes. Improper installation, electrical work, or site preparation may void applicable warranties.

6. Use of Products & Health Disclaimer

Aquavoss Products are intended for general wellness and relaxation purposes only.

7. Warranties

Aquavoss Products may be covered by a limited written warranty provided at or after purchase.

Warranty Supremacy. In the event of any conflict between these Terms, marketing materials, sales communications, or other statements and the written limited warranty, the written limited warranty shall control.

Except as expressly stated in the written limited warranty, all Products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

8. Returns and Cancellations

Due to the custom, bulky, or hygienic nature of many Products, returns may be limited or unavailable. Any return or cancellation policies will be provided at the time of purchase or in a separate written policy.

9. International Customers

Aquavoss currently sells and ships Products only within the United States. If international shipping (including to Canada) becomes available in the future, customers will be solely responsible for customs duties, taxes, import requirements, local regulatory compliance, and any delays or issues arising from cross-border shipping.

10. Intellectual Property

All content on the Site—including text, images, videos, logos, designs, and trademarks—is owned by or licensed to Aquavoss and is protected by intellectual property laws.

You may not copy, modify, distribute, or exploit any content without prior written consent.

11. User Conduct

You agree not to:

  • Use the Site for unlawful purposes
  • Interfere with Site functionality or security
  • Submit false or misleading information
  • Infringe on the rights of Aquavoss or others

12. SMS / Text Messaging Program

Program Name: Aquavoss SMS

Program Description: By opting in to receive text messages from Aquavoss, you consent to receive recurring automated SMS messages regarding order updates, shipping notifications, product information, and promotional offers related to Aquavoss products and services.

Message Frequency: Message frequency varies based on your account activity and preferences. You may receive multiple messages per week during active order periods.

Rates: Message and data rates may apply. Check with your carrier for details.

How to Opt In: You may opt in to receive SMS messages by providing your mobile number on our website, at checkout, or through any other opt-in mechanism made available by Aquavoss.

Opt-Out Instructions: To stop receiving messages at any time, reply STOP to any SMS message you receive from us. You will receive one final confirmation message and no further messages will be sent. To re-subscribe, text START to the same number.

13. Limitation of Liability

To the maximum extent permitted by law, Aquavoss shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, personal injury, or property damage arising out of or related to your use of the Site or Products.

No Reliance. You acknowledge that you have not relied on any statements or representations regarding health outcomes, recovery, performance, or specific benefits in deciding to purchase or use the Products.

In no event shall Aquavoss's total liability exceed the amount paid by you for the applicable Product.

14. Indemnification

You agree to indemnify and hold harmless Aquavoss, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the Site or Products or violation of these Terms.

15. Governing Law, Arbitration & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Products shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

  • Arbitration shall take place in New York County, New York.
  • The arbitrator shall have exclusive authority to resolve disputes relating to interpretation or enforceability of these Terms.
  • Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver. Disputes must be brought on an individual basis only.

Aquavoss may seek injunctive relief in court for misuse of intellectual property.

16. Force Majeure

Aquavoss shall not be liable for delays or failure to perform caused by events beyond reasonable control, including acts of God, extreme weather, natural disasters, pandemics, labor disputes, supply chain disruptions, acts of government, war, terrorism, transportation delays, or failures of utilities or suppliers.

17. Changes to Terms

We may update these Terms at any time. Any changes will be effective when posted on the Site. Continued use of the Site after changes constitutes acceptance of the updated Terms.
